OVERVIEW

Terms and Conditions are rules which one must agree to abide by in order to use our service.

TERMS AND CONDITIONS

Our Disclaimer (see below and available on our website) should be read in addition to the following Terms and Conditions.

ADVERTISED RATES

Rates are per person per night and include breakfast and VAT at the current rate unless otherwise stated. A supplement applies for single occupancy of a double room. Additional persons sharing a room are charged extra. Infants under the age of two stay free when sharing with two adults; a single supplement applies when only one adult is in the room.

High season is from May 1st to September 30th inclusive. Low season prices apply at all other times except on Bank Holiday weekends, between Christmas and New Year, at Easter and during local and national events. Please call or email to confirm rates.

Online booking rates are adjusted accordingly.

All prices are subject to availability and our offers, packages and pricing will fluctuate depending on availability and demand at any given time. All prices are subject to change without notice.

RESERVATIONS

Reservations may be confirmed with valid Visa, Visa Debit, MasterCard, Maestro or American Express card details (not Diners Club). All reservations are confirmed with a booking reference which you should keep a copy of. We reserve the right to charge up to the equivalent of your first night’s accommodation cost as a non-refundable deposit.

At all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, booking dates, room type(s), room rate(s), number of guest(s) and add-on(s) etc.). We cannot be responsible or liable for errors in booking details. The named guest on the Booking Confirmation must include the person staying at the Hotel otherwise we reserve the right to cancel the booking.

For the avoidance of doubt, your reservation price does not include any incidental charges which you may incur during your stay (including, by way of example only, in respect of your use of the Hotel’s bar and mini-bar facilities and the costs of external telephone calls from your room). Such charges will be payable by you on your departure and, in the event that you fail to pay any such incidental charges, it is a condition of your contract with the Hotel that you irrevocably authorise the Hotel to debit your credit or debit card for the amount of any shortfall.

All reservations are accepted subject to availability.

CHECK-IN AND CHECK-OUT TIMES

Guest rooms are available from 2pm on the day of arrival. We ask you to check out by 11am on the day of departure, although late check-out may be available as an extra or on selected offers or promotions.

ARRIVAL

On arrival you may be asked to produce a valid credit card for the Hotel to take pre-authorisation. If you will be settling your account in cash or with a debit card, you will be asked for a deposit to cover the cost of your room for your stay. Please note any extras which you may incur in the Hotel may not be chargeable to your room account.

The Hotel reserves the right to use the guest credit card details to deduct from their account any unpaid outstanding balances e.g. late room charges, fumigation of the bedroom, damage charges etc.

Please note that if you intend to pay cash then we may require government issued photo identification and may retain a copy during your stay.

Guests are advised to read their Welcome Letter and the Room Guest Pack on arrival for information about the Hotel and important safety information.

PAYMENT TERMS

FULL PAYMENT IS DUE ON DEPARTURE from the Hotel. Discounted rates are strictly non-refundable and non-transferable. The Hotel accepts payment by Visa, Visa Debit, Maestro, American Express and Cash (GBP only). We do not accept Diners Club. All rates quoted are subject to availability and inclusive of VAT at the current rate unless otherwise stated. Rates quoted cannot be used in conjunction with any other discount, offer or promotion. Supplements will be applied automatically for single and family room occupancy, or if you upgrade to a suite.

Credit card transactions completed at the Hotel may have an administration surcharge of added to the total bill.

GIFT VOUCHERS

Gift vouchers to be used should be presented on check-in or before paying for a meal.

CANCELLATIONS & AMENDMENTS

All deposits paid are non-transferable and non-refundable in the event of a cancellation. If a reservation is cancelled, the first night’s accommodation will be charged regardless of how long in advance the reservation is cancelled. For cancellations less than 28 days prior to the due start date, 50% of the accommodation originally booked will be charged and if the booking is cancelled within 14 days of the due date of arrival 100% will be charged. We recommend you consider taking out suitable travel insurance, if necessary.

Promotion rates may only be cancelled in accordance with the specific terms applying to that rate which will be advised on the promotion.

In the unlikely event that we have to change or cancel your reservation, we reserve the right to do so. However, you have the right to:

  • accept the changed arrangements as notified; or
  • make alternative arrangements with a sister Hotel; or
  • cancel your reservation and receive a full refund of any monies which you have paid to in respect of your reservation (please note that we shall not be liable for any sums which you have paid to any other persons in connection with your reservation).
    For the avoidance of doubt, we shall have no further liability to you for any changes to or the cancellation of any stay with us.

RELOCATION

In the unlikely event that the Hotel does not, for any reason, have the required number and/or types of rooms available as per the booking, the Hotel reserves the right to relocate you to an alternative Hotel of similar standard in similar locality. The extra and reasonable accommodation expenses incurred for equivalent accommodation (for the first night only) shall at the Hotel’s discretion, which will normally be exercised in favour of you, be borne by the Hotel. The acceptance of this obligation (which will not release you of the obligation to pay Hotel the relevant Charges) shall be in lieu of all other liabilities or obligations, which are hereby expressly excluded.

You acknowledge that the Hotel accepts no liability for any loss or damage suffered by or caused to you in consequence of the relocation.

CHILDREN

All children’s meals must be paid for.

Children under the age of 16 must be supervised by an adult guest at all times.

A family room could include a foldaway bed or a cot but please ensure you let us know your requirements at the time of booking to ensure such items are available.

SPECIAL REQUESTS

Hotel online booking systems allow you to ask for special requests. Whilst every effort will be made to carry out your wishes, unfortunately the Hotel cannot always guarantee to satisfy your requests. Whilst every effort is made to fulfil any particular requests which you may make in relation to your stay with us, please note that these requests do not form part of our contract and we cannot guarantee that we will be able to meet any particular requests.

INCLUSIVE MEALS

Breakfast inclusive breaks include a full cooked breakfast with a selection of hot and cold foods including vegetarian options.

Rates which include breakfast offer a full traditional or continental breakfast with tea or coffee, unless stated otherwise.

Dinner inclusive breaks include a three-course table d’hote menu. Where a Hotel does not offer a table d’hôte menu, an allowance (which varies so please enquire at time of booking) is allocated towards dining from the à la carte menu.
There is no refund for meals which are not taken by guests and lunch cannot be taken in place of dinner.

GENERAL INFORMATION

Although every effort has been made to ensure the accuracy of the information set out on our websites and marketing campaigns, we cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend, supplement or cancel any of the information or offers featured on our websites or email campaigns or otherwise at any time.

All details are correct at time of going to print, however may be subject to change from time to time.

We shall not be responsible for any loss or damage which you may suffer arising out of events beyond our control or the control of our suppliers (including, without limitation, fire, failure of electrical, gas or other power supplies, strikes, industrial action, flood, war, government regulations, riot, terrorist activity, technical problems with transport, illness of entertainers, pandemics, epidemics and bad weather), nor for any curtailment, cancellation or change to any accommodation, activity or itinerary or any other consequences which arise as a result of such events.

All activities have inherent risks to health and safety and the Hotel will not be responsible for any eventualities related to any activities or services booked through the Hotel Website, our partners or during your stay at a Hotel.
For the avoidance of doubt, nothing in these terms and conditions shall operate to attempt to exclude or limit our liability for the death or personal injury of any person caused by the negligence of the Hotel or its employees, servants or agents or to attempt to exclude or limit our liability in any manner which would be unlawful.

NO SMOKING

The Hotels practises a strict NO SMOKING policy. Failure to comply with this policy entitles us to terminate your booking and stay at the Hotel at our sole discretion and you must leave the Hotel immediately without compensation or reimbursement. You shall be liable for any costs, loss or damage incurred by the Hotel, including without limitation any loss or damage to the Hotel room, premises or property or incurred by Hotel guests or third party, arising from your failure to comply with this policy and the Hotel reserves the right to charge you for any such costs, loss or damaged incurred by the Hotel or any Hotel guests or third party.

RESTRICTIONS and RULES

You may not bring the following into the Hotel:

  • pets (except for registered guide and hearing dogs) or livestock;
  • pillows, bed sheets, duvets or other items of bedding;
  • any electrical appliances and/or equipment for heating and/or cooking purposes;
  • food or drink for consumption at the Hotel.

The Hotel reserves the right to remove and/or confiscate any of the above items found in any Hotel room immediately without notice to you and to charge you for any costs incurred for taking such action or for any loss or damage caused to the Hotel room, premises or property or to any Hotel guests or third party as a result of your failure to comply with these terms and conditions.

The Hotel further reserves the right to ask you to leave the Hotel and remove your belongings from the room immediately if we shall, in our sole opinion, deem that you have used a Hotel room in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the Hotel room, the Hotel premises, the other Hotel guests, our staff or any other persons or the reputation of the Hotel, without any compensation and/or any reimbursement to you.

DAMAGE

You are liable for any damage howsoever caused to the allocated room(s) or to the Hotel premises or property caused by you or any persons in your party (whether or not staying at the Hotel) during your stay. The Hotel reserves the right to retain your credit or debit card details and charge or debit such amounts as it shall in its sole discretion deem fit on the said card(s) to compensate or make good the loss, damage, costs or expenses incurred or suffered by the Hotel as a result of the aforesaid.

Regardless, the Hotel further reserves the right to commence legal proceedings against you without notice.

We accept no liability for theft of, or from, or damage to vehicles or bicycles parked on our premises

LOST PROPERTY

The Hotel will not be responsible for any loss or damage of property left in Guest’s room and/or the Hotel property at all times.

Guests are advised to obtain insurance to cover curtailment, and loss of luggage, personal effects, damages, personal injury and money/valuable belongings.

Guests must report any loss of or damage to their property immediately on discovery to the Hotel’s Manager and shall make themselves available to assist with any reports made by the Hotel to the police.

Property that is left behind in the guest rooms will be kept for three weeks. All unassigned property will be forwarded to a charity or disposed of depending value. If we send articles back to the customer, we will charge a postage and packaging fee.

Guests shall not enter areas of the Hotel which are indicated as being closed to the public e.g. Staff Only. The Hotel shall not be responsible for death, personal injury or loss or damage to property suffered by a guest in such areas.

RIGHT TO REFUSE ACCOMMODATION

All rates featured on the Hotel website, our website partners or quoted by telephone or otherwise are offered subject to availability and the Hotel reserves the right to refuse any booking for good reason.

The Hotel reserves the right to refuse accommodation to you or any person(s) without any notice and terminate any booking without being liable for any refund or compensation for the following reasons:

  • the booking has been paid through fraudulent means;
  • the booking has been altered by anyone other than the Hotels or the Hotels’ authorised agents;
  • the booking has been tampered with;
  • the booking conformation has been defaced (in which case the Hotel reserves the right to retain such documentation as evidence);
  • the person checking in is not or cannot prove that he/she is the person named in the Booking Confirmation;
  • as permitted under the provisions of these Terms and Conditions.

COMPLAINTS OR COMMENTS

Any complaint or comment regarding a stay, meal or event should be made in the first instance to the Hotel’s duty manager at the time so it can be resolved. Complaints which cannot be resolved at the Hotel should be notified in writing to the Hotel’s Manager.

PRIVACY & DATA PROTECTION

The Hotel will retain all personal information you provide during booking. By making a booking with us or using the Hotel Website or a partner website, you consent to our use and/or disclosure of your personal details to our: branches, related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents, commercial partners, service providers and/or any other parties engaged by us to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party as the Hotel may, in our sole and absolute discretion, deem necessary for the following purposes:

  • to process your booking and for other administrative purposes;
  • to provide you customer support and services;
  • to send you information on products and services, and special or promotional offers, newsletters or customer survey forms and questionnaires. You may unsubscribe from these at any time by clicking on the “unsubscribe” link or emailing us;
  • we may also be legally obliged to disclose, and you irrevocably consent to our disclosing, your personal information to government and enforcement agencies, regulatory bodies and public authorities or as may be required by law. This may involve sending your personal information between different countries.

We will use our best endeavours to use your personal information in the manner stated herein and will not otherwise disclose your personal information without your prior written consent.

WEBSITE COOKIES

Some parts of the Hotel website may notify you that they may use Cookies. Your use of those parts of the website demonstrates your consent to their use. A Cookie is a small data file and identifier which is downloaded from a website and stored locally on an internet device. The use of Cookies allows the analysis of website visits (e.g. time, date, duration, visit history etc.) and can provide an enhanced experience to the end user (e.g. tailor preferences, store settings etc.). Different internet browsers and configurations accept and use Cookies differently. Consult the ‘help’ section of your internet browser instructions for further information about how Cookies are used in your browser and how you may enable or disable their use. Our website shall still function without the use of Cookies but the user experience and functionality may be limited.

The Hotel website uses cookies to:

  • maintain your internet session and required details when you browse the Hotel website, during account registration and during the booking process (session cookie);
  • collect website usage data for statistical/analytics purposes (analytics cookie);
  • direct you to the correct landing page based on your geo-location (geo-targeting cookie).

COPYRIGHT

The Hotel website and those of our partners including booking and other applications, text, graphics, designs, audio and video clips, Hotel and destination information and all other content thereon are the property of the Hotel and/or our partners.

You may use the Hotel website and its content solely for personal, non-commercial and private use subject always to applicable copyright laws.

All trademarks, trade names, service marks and all other marks, whether registered or unregistered, on the Hotel website are owned by or licensed to the Hotel and their respective owners and may not be used, reproduced or modified without the prior written approval.

WEBSITE LINKS

The various linked sites on the Hotel website allows for further link-up and interaction between Guests and the said sites for promotions and other interactive mediums. The inclusion of all website links on our website does not imply endorsement by us of such linked sites, or any association with their operations, services or products. These sites are outside the control of the Hotel. We will not be responsible for the content on the linked sites or your use thereof.

WIFI ACCEPTABLE USE POLICY

All guests using the Hotel free WiFi service agree to abide by the Hotel WiFi Acceptable Use Policy. This policy is available on our website.

ACCURACY AND TRANSLATION

The Hotel will not be liable for any direct, indirect, consequential, punitive losses or damage (including without limitation loss of revenue, loss of goodwill, loss of reputation and loss of, or damage to data), arising out of the Hotel website or the use thereof or any services purchased from the Hotel website, or any errors, inaccuracies or omissions in the services or content provided howsoever caused.

Website translation services are not always accurate and any translated webpages should not be relied upon for accuracy. If there is any conflict or discrepancy between the English text of these Terms and Conditions and any translation thereof into any other language, the English text shall prevail.

TRADING NAME

The Liddesdale Hotel is a Trading name with VAT No: 179090481.

GOVERNING LAWS

Your contract with the Hotel is governed by the laws of Scotland and any disputes shall be settled in the courts of this country. These Conditions shall be governed by Scottish law and you agree to submit to the jurisdiction of the Scottish courts.

CHANGES TO THE THESE TERMS & CONDITIONS

The Hotel reserves the right to cancel, amend or vary the arrangements and content featured on the Hotel website and/or change, amend, vary or add to these Terms and Conditions at any time without prior notice. Please check the Hotel website regularly for updates to these Terms and Conditions.
